Note: Most states have enacted laws and regulations to protect wetlands. In many cases, these rules are established to define the state's role in the "404 permit/401 certification process." Construction Permit Process - State Rules

  • How Are Wetlands Activities Regulated by Utah? The Utah State Division of Water Quality and the Utah State Water Quality Board regulate wetlands as waters of the state under Utah's water quality standards.

  • Wetlands. Wetlands are "waters of the state," meaning "all streams, lakes, ponds, marshes, water courses, waterways, wells, springs, irrigation systems, drainage systems, and all other bodies or accumulations of water, surface and underground, natural and artificial, public or private, which are contained within, flow through, or border upon this state or any portion thereof."

  • Wetland Categories. Persons must seek the Division's approval before discharging waste into state waters or constructing any device for the treatment or discharge of wastewater. The use of industrial wastewaters are subject to approval by the Board on a case-specific analysis involving health and environmental concerns. Persons cannot use, dispose, or manage sewage sludge by any method where pollutant limits, management practices, and operational standards for pathogens and vector attraction reduction requirements are established under 40 CFR 503.

  • Regulated Wetland Activities. Individual waste disposal systems can submit their construction plans to the local health authority that has jurisdiction, instead of the Division. Small Animal Waste Lagoon construction plans are not submitted to the Division, if the USDA Natural Resources Conservation Service (NRCS) certifies the plan and it complies with the existing Memorandum of Agreement between the Division and the NRCS.
